Retained by Wexler Wallace

The Vega team was retained by Wexler Wallace to support a damages expert in analyzing the amount of damages suffered by members of the certified class who held a minority share of certain umbrella partnership real estate investment trust (UPREIT). The expert analyzed damages in the following four categories:

  • breach of the Declaration of Trust (DOT) and tortious conduct stemming from breach of the DOT
  • minority oppression and inequitable conduct
  • unjust enrichment
  • distributions resulting from an asset transfer

The case settled.
